This book reconstructs Heidegger’s philosophy of time by reading his work with and against a series of key interlocutors that he nominates as being central to his own critical history of time. In doing so, it explains what makes time of such significance for Heidegger and argues that Heidegger can contribute to contemporary debates in the philosophy of time. Time is a central concern for Heidegger, yet his thinking on the subject is fragmented, making it difficult to grasp its depth, complexity, and promise. Heidegger traces out a history that focuses on the conceptualisations of time put forward by Aristotle, Plotinus, Augustine, Kant, Hegel, Bergson, and Husserl – an “alternative history of time” that challenges how time has been defined and studied within both philosophy and the sciences. This book explores what happens when we take seriously Heidegger’s claim that these seven figures are essential to any understanding of time, setting out what this can tell us about existence, possibility, and philosophy as a historical discipline. “Jury trials are supposed to encourage public trust in the criminal legal system while protecting fundamental fairness for the defendant. But how can the public help ensure the fairness of criminal trials when it has no meaningful way to understand the reality of what happens every day in criminal courtrooms across the country? This Article presents findings from an original pilot study—believed to be the first and largest such study—that collected and analyzed court documents and transcripts from seventy-five state criminal trials from one court in one state in one year. It posits that the public’s understanding of the significance of a criminal defendant’s testimony may be distorted and questions its ability to ensure fairness of trials and trust in the legal system when the public—including judges, prosecutors, and defense attorneys—is operating in the dark. The study found that defendants who testified had better sentencing outcomes compared to those who did not, and they were more likely to be acquitted of their most serious offense and less likely to be sentenced to incarceration. By exploring these findings, the pilot study suggests that greater access to data from state criminal trials is critical to better understanding the significance of criminal defendants’ testimony on trial outcomes. What we don’t know matters because misunderstanding the reality of the decision to testify undermines the right to a fair trial and trust in the criminal legal system.”

Analyzing conflicts of interest is a critical part of the daily life of a lawyer, although the urgency and complexity of conflicts are difficult to teach in a meaningful way. After teaching conflicts to law students enrolled in Professional Responsibility courses and discussing conflicts with lawyers in ethics presentations, the author has developed a method for teaching conflicts of interest that is accessible and (hopefully) memorable. This Article presents that method. By using an evolving fact pattern as the analytical lens for studying conflicts, students learn how conflicts emerge, converge, and diverge as facts develop. Beginning with a personal injury accident that causes a married couple to seek legal advice, the narrative progresses through predictable-and unpredictable-turns. As the narrative evolves, so do the conflicts. By learning conflicts through a focused and evolving lens, law students better understand the complexity of conflicts of interest analysis.

This Essay investigates the legacy of Gideon by examining the de facto courts of last resort for convicted offenders: the federal courts of appeals. Part I focuses on the U.S. courts of appeals’ judges and caseloads, revealing that very few federal appellate judges have prior criminal defense experience, despite the fact that half of their caseload consists of criminal and quasicriminal appeals. Part II posits that in an era of mass incarceration, the perspective of judges who have had criminal defense experience may be especially vital because judges’ lack of criminal defense experience may affect their ultimate assessment of the merits of criminal and quasicriminal appeals. The Essay calls for further research to investigate whether federal appellate judges’ prior experience in criminal defense or prosecution may affect their determination of the merits of a criminal conviction.

Habeas corpus law changed dramatically after Congress passed the Anti-Terrorism and Effective Death Penalty Act (AEDPA) in 1996. This new book provides a comprehensive view of the latest developments in the field and will continue to be supplemented as Congress passes new legislation and as courts try to make sense of how that legislation affects habeas law. After providing a background on the history of habeas corpus and an overview of common habeas corpus claims, the book examines subject matter jurisdiction, habeas corpus litigation, clemency, stays of execution, and innocence. The book concludes by examining the future of habeas corpus litigation. While this book is primarily intended for law students, it will be useful for attorneys specializing in post-conviction and habeas work. It will also be a valuable addition to the libraries of appellate public defenders across the country. A teacher's manual is available.

This article serves as the concluding article for the DePaul University Law Review Race to Execution Symposium, which explored the role of race in the capital punishment system in the United States. This article examines the contributions to the symposium using keynote speaker Bryan Stevenson’s challenge to think critically about the identity required to confront and challenge the politics of race and the death penalty, specifically noting the importance of the identities of five types of decisionmakers: the jury, judges, policymakers, prosecutors, and defense attorneys. This Article uses Stevenson’s five-part framework as a prism through which to view the comments of the other conference speakers, a juxtaposition that enables critical analysis about the identity of each of the decisionmakers, as well as valuable insight into how each of the decisionmakers thinks.
