This IBM® Redbooks® publication provides IBM z/OS® development and test organizations with the information to develop and establish agile testing practices for their z/OS applications. It is assumed that readers know about software development, quality assurance, agile development processes, and DevOps. You might think that applying agile testing to z/OS applications is not practical or efficient due to a lack of good tools. In this publication, we hope to dispel that myth by sharing how developers and testers can apply agile testing practices to their z/OS applications and the tools that can help to accelerate their processes. The intended outcome is for z/OS development organizations to compare how they are testing today and determine whether there is an opportunity to transform testing practices and apply new tools to improve quality and gain efficiencies. In predominately male workplaces, sexualized “horseplay” is common. While this type of conduct can be a tool of gender subordination, it also is a tool for fostering camaraderie and collegiality among co-workers. In other words, some workers, including women, find that engaging in sexual horseplay is necessary in order to “fit in.” This Article critiques the failure of courts to appreciate the peer pressure to “fit in” when they analyze Title VII sexual harassment cases. This oversight is especially evident when courts try to determine whether a plaintiff found particular sexual conduct to be “unwelcome.” If a plaintiff voluntarily engages in instances of sexual conduct in order to fit into her workplace and in order to advance in her career, it is quite likely that a court will fail to determine that any other sexual conduct that she experienced was “unwelcome,” even with respect to conduct that targeted and demeaned her in ways that no one would actually welcome. This Article urges courts to apply a more nuanced approach, and it highlights the types of evidence that courts need to be examining with more scrutiny in order to determine whether conduct was “unwelcome” within the complicated dynamics that occur among genders in the workplace. The focus of this Article is female plaintiffs in male-dominated workplaces. But given the centrality of male-on-male horseplay within the systemic practice of workplace sexual harassment, the approach this Article advocates ultimately will benefit workers of all genders in all workspaces. In order for courts to engage in this more nuanced analysis, however, plaintiffs' lawyers also need to be aware of the pressure to fit in as they engage in discovery and strategize about the best evidence and arguments to present in support of their clients' claims.

The war on crime exemplifies how the deprivation of privacy makes one vulnerable to oppressive state social control. Scholars have severely criticized the war on crime's subordinating effects on poor urban people of color. The role that privacy deprivation plays in this subordination, however, has been under-theorized. This Article takes an initial step in addressing this gap in the literature. It argues that one important reason why the war on crime is so abusive is because it oppressively invades individuals' privacy; poor people of color have limited opportunities in the creation of their life plans, participation in mainstream political discourse, and access to social capital in part because they have limited privacy. These privacy invasions also have an expressive aspect because they send the message that the state does not trust these individuals to engage in valued activities in legitimate ways; therefore, they must constantly be watched. As a result, the deprivation of privacy also results in serious dignitary harms. This Article further argues that current criminal justice policies cannot even be justified on utilitarian grounds. Indeed, the privacy invasions this Article describes contribute to counterproductive criminal justice policies. While this Article focuses on poor people of color, it cautions that they are the canary in the mine. Whites are also currently experiencing serious privacy invasions in the form of mass surveillance and DNA collection. The practices of harsh sentencing and overcharging are making them even more vulnerable to further privacy invasions. The truth is that for all Americans, criminal justice policies are steadily minimizing the line between the individual and the state.
