Sodann werden datenschutzrechtliche Fragen näher beleuchtet. Im Mittelpunkt steht dabei zum einen die Zulässigkeit der Anwendung von KI-Systemen im Bewerbungsverfahren und zum anderen das Verbot automatisierter Entscheidungen im Einzelfall. Des Weiteren stellt sich die Frage, in welchen Konstellationen Diskriminierungsgefahr durch KI-Systeme besteht und ob Bewerber u. U. Ansprüche gegen den Arbeitgeber geltend machen können. Schließlich wird auf die Haftungsproblematik im Zusammenhang mit KI-Systemen eingegangen. Unter dem Stichwort „Digitalisierung der Arbeitswelt“ werden schon seit Jahrzehnten die technischen Fortschritte im Bereich der Arbeit diskutiert. Aktuell scheinen das Tempo des Fortschritts und die damit einhergehenden Auswirkungen auf das Arbeitsleben jedoch andere Ausmaße angenommen zu haben. So ist mitunter die Rede von einer vierten industriellen Revolution bzw. Industrie/Arbeiten 4.0. Immer größere Bedeutung erfährt dabei auch der Einsatz von künstlicher Intelligenz (KI). Damit sind zumeist selbstlernende und zum Teil autonom handelnde Systeme gemeint, deren Funktion darin besteht, menschliche Tätigkeiten auszuführen. Diese Aufgaben soll KI nach Möglichkeit jedoch schneller, effektiver und weniger fehlerbehaftet ausführen als der Mensch. Diese Entwicklungen haben auch vor dem Prozess der Personalbeschaffung, dem Recruitingprozess, nicht Halt gemacht. Vor allem, wenn es um die Auswahl von Bewerbern für eine zu besetzende Stelle geht, gibt es verschiedene Einsatzmöglichkeiten für KI. In rechtlicher Hinsicht stellen sich hierbei insbesondere Fragen des Beschäftigtendatenschutzes und des Diskriminierungsrechts.
