The three Articles that comprise this Dissertation explore how free expression and judicial federalism regulate hurtful speech and promised silence. The Articles tackle torts and free speech, contracts and free speech, and a comparative variation on those two themes. Judicial federalism threads all three Articles. The first Article, Silencing State Courts, argues that the current mode of enforcing the First Amendment against state common law speech torts fails to promote cooperative judicial federalism. Second, Silence for Sale argues that state courts should free themselves from constitutional straitjackets and recognize a robust public policy of free expression that voids some nondisclosure agreements. Finally, Comparative Judicial Federalism argues that the strength of a federal free speech guarantee varies with a country''s particular species of judicial federalism. By comparing free speech and judicial federalism in the United States and Australia, it argues that Australia’s judicial federalism augments its implied freedom of political communication.

The Design of Knowledge-rich Browsing Interfaces for Retrieval in Digital Libraries
One of the most challenging problems in the field of information science is developing effective retrieval interfaces for digital libraries. Solutions to this problem must provide interfaces that mediate between the retrieval needs of library users and any available collection materials in an intelligent and tractable manner. The majority of research in this area has focused on the development of information retrieval systems that attempt to match users textual queries to library records. An alternative approach is to build retrieval interfaces that allow users to direct their own searches by browsing through an organization of a library''s materials. This dissertation specifies the design characteristics of browsing-based retrieval interfaces for digital libraries. This design has been implemented in Deja vu, a computer program that solves the retrieval problem in the following ways. First, rather than browsing through library materials directly, users of Deja vu browse through an organization of the thesaurus terms that library archivists have used to index collection materials. Second, a tight integration between thesaurus terms and library records allows Deja vu to provide information about the availability of materials in a collection throughout the browsing process. Third, Deja vu provides a rich browsing space to users by utilizing new knowledge structures called Expectation Packages. Expectation Packages cluster sets of terms from a thesaurus into fully interconnected groups, forming simplified cognitive science knowledge representations. By creating a set of these Expectation Packages for a particular thesaurus, developers can efficiently create a rich browsing space that reflects the knowledge that is common to the intended users of a digital library. A full set of Expectation Packages were developed for one thesaurus which is used by many photographic libraries. Deja vu was then evaluated in the context of its use as a retrieval interface for large digital collections.

This paper attempts to describe the religious and civil religious discourse used by presidents during their inaugural addresses and State of the Union speeches, overlooked in the literature. This deductive, plausibility probe categorizes different words into different categories. It begins by offering definitions of religion and civil religion, separating interested words into either religious or civil religious categories, and then further attempts to subcategorize relevant words into groups that may explain a possible usage for their choice in the speech. From these subcategories, possible hypotheses were developed for future research. From the study, results show that religious and civil religious discourse is used for several purposes (ties to history, links to a common heritage, creating a common belief, policy objectives). This paper also presents limitations with the study and directions for future research into political discourse regarding religious and civil religious usage.
