Strategic Contracting in China for Foreign Firms

release date: Jan 01, 2022
Strategic Contracting in China for Foreign Firms
There is serious debate within the global business community regarding the value of the Chinese court system and written business contracts in China. One side asserts the validity of such contracts and that Chinese courts are good at enforcing them. The other side argues the contrary. Using data from several sources, we demonstrate that the legal system and well-written contracts do, in fact, matter in China. This article also recommends how contracts can be structured and strategically used to make doing business in China and with Chinese firms more predictable and efficient.

Creative Agency

release date: Aug 20, 2021
Creative Agency
This book offers a socio-cultural examination of contemporary creativity studies. Drawing heavily on posthumanist, new materialist and affective theoretics, the author argues in favour of an expansive and sustainable approach to creativity which contributes to an emergent ‘creativity studies’ inter-discipline. It seeks to establish a broader consideration of creativity in socio-culture, that extends beyond, or indeed refutes, the narrowing aperture of entrepreneurship and innovation as synonyms for creativity in economic, cultural and educational contexts and discourses. Drawing on multiple case studies of creative relational and creative ecological empirical research, this book integrates a concern for personal, planetary and geo-political collaboration, as an antidote for ‘innovation for innovation’s sake’.

Contracting in China

release date: Jan 01, 2020
Contracting in China
Supply chain contracts in developing markets such as China were once not worth the paper they were written on. As the market and legal systems matured, however, savvy organizations started to use supply contracts to protect the integrity of their global supply chains. In this article we address the legal and strategic steps that a successful supply chain contract in China follows, so that it is well written and the Chinese supplier is more likely to read, understand, and actually comply with it. When such recommendations are followed, a Chinese court will also be more likely to understand and enforce that supply chain contract.

China Supply Chain Contracts

release date: Jan 01, 2020
China Supply Chain Contracts
A well crafted and reasonable liquidated damages provision is one of the best leverage tools available for preventing the counterpart and supplier in a supply chain contract from breaching their agreements. This is also the primary reason for having a written contract in the first place. In this article, we discuss what the parameters of a good liquidated damages provision should look like in a China focused supply chain contract.

Contracting for Success with Chinese State-Owned Enterprises
Foreign firms doing business in or with China are likely to sell products and services to Chinese state-owned enterprises. 10% Happier 10th Anniversary

release date: May 21, 2019
10% Happier 10th Anniversary
In celebration of its 10th anniversary, a revised and updated edition of the award-winning #1 New York Times bestseller that changed the way we look at meditation, expanded with new material by Dan Harris. After having a nationally televised panic attack on Good Morning America, Dan Harris knew he had to make some changes. A lifelong nonbeliever, he found himself on a bizarre adventure involving a disgraced pastor, a mysterious self-help guru, and a gaggle of brain scientists. Eventually, Harris realized that the source of his problems was the very thing he always thought was his greatest asset: the incessant, insatiable voice in his head. We all have an inner narrator. It’s what has us losing our temper unnecessarily, checking our email compulsively, eating when we’re not hungry, and fixating on the past and the future at the expense of the present. Most of us assume we’re stuck with this voice—that there’s nothing we can do to rein it in—but Harris stumbled upon an effective way to do just that. 10% Happier is now considered a classic text on the power of meditation, an introduction to the practice that can convert even the most hardened skeptic. With over a million copies sold, 10% Happier is the go-to guide, and with meditation now a widely accepted and encouraged practice, Dan Harris is a pivotal and approachable figure in the field who has built a thriving platform based on the ideas he first presented in this book. In this 10th Anniversary Edition, Harris offers a new preface reflecting on how much has changed—for him and for the public perceptions of meditation, plus a revised and expanded appendix, filled with guided meditations and practical advice for people looking to boot up a habit.

After having a nationally televised panic attack, Dan Harris knew he had to make some changes. A lifelong nonbeliever, he found himself on a bizarre adventure involving a disgraced pastor, a mysterious self-help guru, and a gaggle of brain scientists. Eventually, Harris realized that the source of his problems was the very thing he always thought was his greatest asset: the incessant, insatiable voice in his head, which had propelled him through the ranks of a hypercompetitive business, but had also led him to make the profoundly stupid decisions that provoked his on-air freak-out. Finally, Harris stumbled upon an effective way to rein in that voice, something he always assumed to be either impossible or useless: meditation, a tool that research suggests can do everything from lower your blood pressure to essentially rewire your brain. 10% Happier takes readers on a ride from the outer reaches of neuroscience to the inner sanctum of network news to the bizarre fringes of America’s spiritual scene, and leaves them with a takeaway that could actually change their lives.

Meditation for Fidgety Skeptics

release date: Dec 31, 2018
Meditation for Fidgety Skeptics
THE NEW YORK TIMES BESTSELLER FROM THE AUTHOR OF 10% HAPPIER Too busy to meditate? Can’t turn off your brain? Curious about mindfulness but more comfortable in the gym? This book is for you. You’ll also get access to guided audio meditations on the 10% Happier app, to jumpstart your practice from day one. What exactly is meditation? ABC News anchor Dan Harris used to think that meditation was for people who collect crystals, play Ultimate Frisbee, and use the word “namaste” without irony. After he had a panic attack on live television, he went on a strange and circuitous journey that ultimately led him to become one of meditation’s most vocal public proponents. Harris found that meditation made him more focused and less yanked around by his emotions. According to his wife, it also made him less annoying. Science suggests that the practice can lower your blood pressure, mitigate depression and anxiety, and literally rewire key parts of the brain. So what’s holding you back? In Meditation for Fidgety Skeptics, Harris and Jeff Warren, a masterful teacher and “Meditation MacGyver,” embark on a gonzo cross-country quest to tackle the myths, misconceptions, and self-deceptions that keep people from meditating. It is filled with game-changing and deeply practical meditation instructions—all of which are also available (for free) on the 10% Happier app. This book is a trip worth taking. Praise for Meditation for Fidgety Skeptics “If you’re intrigued by meditation but don’t know how to begin—or you’ve benefited from meditation in the past but need help to get started again—Dan Harris has written the book for you. Well researched, practical, and crammed with expert advice, it’s also an irreverent, hilarious page-turner.”—Gretchen Rubin, author of The Happiness Project “The ABC News anchor, a ‘defender of worrying’ who once had an anxiety attack on air, offers a hilarious and stirring account of his two-steps-forward-one-step-back campaign to sort ‘useless rumination’ from ‘constructive anguish’ via mindfulness, along with invaluable suggestions for following in his footsteps.”—O: The Oprah Magazine

Meditación para escépticos inquietos

release date: Oct 02, 2018

Risk and Return for Regulated Industries

release date: Apr 27, 2017
Risk and Return for Regulated Industries
Risk and Return for Regulated Industries provides a much-needed, comprehensive review of how cost of capital risk arises and can be measured, how the special risks regulated industries face affect fair return, and the challenges that regulated industries are likely to face in the future. Rather than following the trend of broad industry introductions or textbook style reviews of utility finance, it covers the topics of most interest to regulators, regulated companies, regulatory lawyers, and rate-of-return analysts in all countries. Accordingly, the book also includes case studies about various countries and discussions of the lessons international regulatory procedures can offer. - Presents a unified treatment of the regulatory principles and practices used to assess the required return on capital - Addresses current practices before exploring the ways methods play out in practice, including irregularities, shortcomings, and concerns for the future - Focuses on developed economies instead of providing a comprehensive global reviews - Foreword by Stewart C. Myers

Good, Better, Best-Maximize Your Leadership Ability

release date: Jul 11, 2016
Good, Better, Best-Maximize Your Leadership Ability
Dan Harris offers his own take on how to become a great leader with this informative eBook: Good, Better, Best - Maximizing Your Leadership Ability. Harris''s book begins with an explanation of the differences between leadership and management, the latter being what the author refers to as the attributes of leadership. The comparison of management and leadership is followed by an explanation of the myth of leadership, or everything you thought leadership was but isn''t in reality. After the author takes the opportunity to dispel the preconceived notions readers had about leadership, he can begin to describe leadership through the next several chapters, the titles of which indicate that leadership will be defined through a series of positive character traits. The character traits which the author finds essential to great leadership skills begin with integrity, which is equated with the ability to live honestly. In addition to having integrity, readers are next encouraged to see the ability to delegate as the next topic addressed. Only those who have mastered the ability to delegate will come to realize that they truly are not alone in any endeavor when there is a team which can be led to accomplish the goal together.Great leaders are further encouraged to show humility. Humility is defined by this author as showing strength, yet having compassion. Humility can also be defined as subduing the tendency to show arrogance and/or flaunt one''s superiority. It can become extremely difficult to lead when your subordinates despise you. Counseling on courage follows the chapter on humility, where you will no doubt be advised how there will be times when the going gets tough and you have to motivate the team to keep going. The skill which arguably should be at the top of the list is the focus of the next chapter: developing those great communication skills. How will you lead your team to success if you cannot communicate well? Great communication skills will open doors and smooth over the bumpy portions of the road which lies before you. You will be utterly amazed at the value of having and maintaining positive and efficient communication with everyone with whom you need come in contact. After exploring traits and skill sets, the second half of the book deals with attitude and approach. Positive attitude is combined with an optimistic outlook of knowing you can accomplish your goals. If you believe in your abilities and have the creativity to develop workable solutions for the unexpected challenges to come before you, then surely you will succeed. Interesting from start to finish, How Good, Better, Best - Maximizing Your Leadership Ability is a practical and straightforward self-help title by Dan Harris which is conveniently available in digital eBook form.
