The bill would amend the Clean Air Act to establish a cap-and-trade system designed to reduce U.S. greenhouse gas emissions 17% below 2005 levels by 2020 and 83% below 2005 levels by 2050. The market-based approach would establish a cap on the emissions and would allow trading of emissions permits (¿allowances¿). The bill contains energy efficiency provisions that cover grants, standards, rebates and other programs for bldgs., lighting and commercial equip., water-using equip., wood stoves, industrial equip., and healthcare facilities. The physical security of nuclear power plants (NPP) and their vulnerability to acts of terrorism was elevated to a national security concern following the 9/11 attacks. Since then, Congress has focused oversight and legislative attention on NPP security requirements. The Energy Policy Act of 2005 act required NRC to conduct ¿force-on-force¿ security exercises at NPP at least once every 3 years. In these exercises, a mock adversary force from outside a NPP attempts to penetrate the plant¿s vital area and simulate damage to key safety components. Omnibus energy legislation (H.R. 4) that is now in conference would expand energy tax incentives significantly. The House passed the bill on August 2, 2001, and the Senate approved its version April 25, 2002. Several energy tax issues are addressed in these bills: 1) tax incentives to increase the supply of oil and gas, and the demand for coal; 2) energy tax issues relating to energy conservation and energy efficiency; 3) energy tax issues relating to alternative fuels; 4) selected issues relating to electricity restructuring; and 5) expiring energy tax provisions.

The Department of Energy (DOE) is studying a site at Yucca Mountain, Nevada, for a permanent underground repository for highly radioactive spent fuel from nuclear reactors, but delays have pushed back the facility’s opening date to 2010 at the earliest. In the meantime, spent fuel is accumulating at U.S. nuclear plant sites at the rate of about 2,000 metric tons per year. Major options for managing those growing quantities of nuclear spent fuel include continued storage at reactors, construction of a DOE interim storage site near Yucca Mountain, and licensing of private storage facilities. Arguments for development of a federal interim storage facility include DOE legal obligations, long-term costs, and public controversy over new on-site storage facilities. Opposition to centralized storage centers on the potential risks of a large-scale nuclear waste transportation campaign.
