Patent Purchases and Litigation Outcomes

release date: Jan 01, 2020
Patent Purchases and Litigation Outcomes
We test empirically whether purchased patents that are litigated fare better or worse than litigated patents that aren''t purchased. We identified every case filed in 2009 and 2010 that had a definitive winner and had information on the presence or absence of an assignment or other transfer. That left us with 516 decisions. Of those 516 decisions, the patentee won 125, or 24.2%. Of the patents, 280, or just over half, had been transferred before the litigation began. We find that overall, patentees won 21% of the time with patents that had been sold before litigation began, and 28% of the time with patents they developed in-house. But combining all patent cases may obscure important differences between plaintiffs who buy patents and those who don''t. Dividing our study into entity types produces a surprising result. Operating companies fare better when they assert patents they developed in house. They won 33% of the time when asserting their own patents, but only 23% of the time when asserting purchased patents. By contrast, inventor-owned NPEs -- but not patent assertion entities -- do better with purchased patents. The results also differ by area of technologyOur results have implications for the design of patent markets and for the efficiency of patent licensing transactions.

An Empirical Look at the 'Brokered' Market for Patents

release date: Jan 01, 2018
An Empirical Look at the 'Brokered' Market for Patents
We study five years of data on patents listed and sold in the quasi-public “brokered” market. Our data covers almost 39,000 assets, an estimated 80 percent of all patents and applications offered for sale by patent brokers between 2012 and 2016. We provide statistics on the size and composition of the brokered market, including the types of buyers and sellers who participate in the market, the types of patents listed and sold on the market, and how market conditions have changed over time. We conclude with an analysis of what our data can tell us about how to accurately value technology, the costs and benefits of patent monetization, and the brokered market''s ability to measure the impact of changes to patent law.

Neferkheperura

release date: Nov 07, 2014
Neferkheperura
NeferKheperura and the Legend of the Golden Pharaoh - By Michael J. Costa, (c) 2014: Excerpt: Four Hours Later, Michael Beshter''s Apartment, New York, USA Was it wrong to bring Vivian back to his living space? His identity was safe for now. Michael and Vivian dined in that night, via room service in a secure room. A common delight: NY Steak, mashed potatoes with gravy, and a melody of fresh veggies with a fine white wine from California was the main course. Dessert was a rich chocolate Mud Pie, served for two. Afterwards, Michael showed her his various framed College papers, some Degrees, and a trophy for first place in a College Kung Fu tournament. These he had brought over from his original home some 2 Miles away, much to the approval of his sister. Vivian educated him about her background and social life. She was born in Las Vegas, Nevada to a civil engineer and an office secretary, both of European descent. She graduated with honors from a private university before moving to New York, where she was employed as a Fashion Designer for the last 14 years. Her choice of apartment coincided when the Museum moved in several floors above her. Her neighbor is a local Nightclub owner, so her social life revolved around learning to dance and filling beverage orders from patrons. While teaching Michael to dance, Vivian realized the time. "Oh my, it''s late... I have to feed my cat, you know," she said. "I can call my driver," Michael reminded her. "It won''t take up much of your time." "Really? Oh that would be so cool," she said. "Michael?" "Yes?" "I just want to thank you for everything, really. You''ve been a great Host, and friend," Vivian said. "Um, by the way, why is there a red light focused on your back?" "What red light?" he asked. "It''s coming from your window," Vivian noticed. Suddenly two loud pops hit the glass from behind them. Vivian thought a champagne bottle exploded until her right hand felt some liquid drop from his back. Then she screamed. "MICHAEL!" she yelled. "You''ve been shot!" Michael Beshter collapsed to the tiled floor, with her holding onto him. He inched towards her, whispering something. "Get my ring. It''s in the front pocket of my blazer," Hysterical, Vivian searched frantically for the correct pocket. "I found it!" "Quick, hand me it," he said in pain. "What''s a ring supposed to...?" she asked. Michael placed the ring on his right third finger, and then rubbed it until it lit up like a light bulb. He rubbed his back with it. The blood disappeared as did the rifle pellet. Vivian backed away. "What the Hell just happened?" she said while cowering from the window. Michael started to stand up, and then reached for his cell phone and pressed 996*. Panels fell from the ceiling, blocking all windows with bullet-proof armor. The back bookshelf wall rotated around on an invisible turn-table, revealing a set of mannequins wearing Flight Suits with the Green Stones on them. Three computer terminals popped into place, all active. And a chair emerged from the floor, with console components on the arm rests. A camera fed images to the view screen of the surrounding area as the female-voiced computer gave instructions on audio. Michael Beshter groggily walked to the station and was seated. He removed a tube from the side of the chair and placed it into his mouth, drinking slowly. It was medicine for a post-traumatic gunshot disorder. His Flight Suit was visible to Vivian, as she investigated his equipment, and then turned to him with her mouth gaping open in astonishment. "Oh my God, you''re that guy..." she said. Michael briefly kissed her face, and then started programming.

Tutankhamon's Wadjetism

release date: Sep 07, 2014
Tutankhamon's Wadjetism
Tutankhamon''s Wadjetism ~ Copyright 2014 Michael J. Costa, All rights reserved.3300 years ago in the Capital City of Kemti (Ancient Egypt) the Pharaoh Tut-ankh-amon decided between 2 opposing religions - the Monotheism of Aton that later became Judaism and the traditional Polytheistic Spirit worship of his ancestors. He chose to remove the Atonist element because the Monotheists were destroying all references to the traditional religion, in doing so Tutankhamon became the Christ (the Anointed One), the Son of Ra, and the Savior of the World. The traditional religion is preserved as Christianity (the Wadjet Eye of Sacrifice became the Body of Christ in the ceremonies of the Eucharist/ Communion and the Opening of the Mouth ceremony of Kemti) and in Islam (the way Muslims pray is the same gesture as when one surrenders unto Pharaoh, and the colors of Osiris - green and black - with attributes of Osiris as Judge of the Dead and Sovereign of the Living). Tutankhamon himself was buried with anointing oils and his mummy was covered in it, proving he was the Anointed One. Tutankhamon''s Wadjetism is the Orthodox Religion of the last 3300 years, and the next 1000+ years. Copyright (c) 2014 Michael J. Costa, All rights reserved.

Nomarch's Tomb

release date: May 02, 2014
Nomarch's Tomb
Nomarch''s tomb - A Strategy Game about Ancient Egypt - by Michael J. Costa: Nomarch''s tomb is a strategy game that consists of 3 square grids representing 3 land regions of Ancient Egypt. The players move their pawns in these grids, collecting property cards upon landing on a square and either buying the land or conquering it with their Army, also represented as cards. Gold is earned by the player for farming (buying farm land), appeasing the gods (buying Temples), conquest (using Army cards with dice to determine results), or trade (trading cards with other players). Players may land on a marked square for certain actions. Use "Plunder" Cards where the player takes 3 cards from all players (or an amount of gold if no cards are available); "Tribute" where the player gives 1 card to all other players (or gold); "Oracle" using the Oracle Deck of cards for certain actions; & "Golden Coffers" Card Deck that gives rewards. When the player has enough gold and property cards then s/he may build their Tomb and Mortuary Temple. The Tomb is an untouchable property card held in place by a Pyramid piece. The game ends when one player completes the Tomb and Mortuary Temple and becomes a Nomarch. The winner then plays a Bonus Game of Senet to secure their afterlife and earn more rewards from the Golden Coffers deck. Senet is played with all the player pawns in the game; up to 7 players are possible for Nomarch''s Tomb. Copyright 2014 Michael J. Costa, All rights reserved.

Californian Pharaoh

release date: Jul 24, 2013
Californian Pharaoh
Californian Pharaoh: A collective memoir. "The memory was still present, its images fresh from the vortex of life, still brimming with static energy waiting to be extinguished by dementia. The air was stale, I inhaled deeply. I remembered the agent''s own words: "left button will signal the agent to assassinate Fidel Castro. Right button will signal our man to take you out." All right, it''s done. "Are you sure you want to do this Mr. President?" a woman asked. "I''ll just reincarnate someplace else," I said. ... Then the car moved by the Secret Service man, who I waved down from the aisle. My right hand gripped the remote device in my jacket pocket. I pressed the left button; it was stuck. This was typical of the CIA technology. So I pressed the right one. Of course, that one worked. It''s always the right one, I thought to myself. The car neared the clearing. A faint memory lingered: "You can''t say Texas doesn''t love you, Mr. President." Two shots fired. One hit my neck from behind. I urged my wife, Jackie, closer; I wanted to tell her something important. Then the second one hit my head; it felt like a Stroke. Then my body became limp as I broke free from my prison of flesh and blood. . . I floated up into the air, not looking back..." Copyright 2013 Michael J. Costa, All rights reserved. Read this autobiography of the true reincarnation of notable personalities: Thutmose 3, Nebkheperura (Tutankhamon the Anointed One), Ramses 2, Siddhartha Gautama, the Chinese First Emperor, G. Julius Caesar, Joshua the Scribe, various Conquerors and Pharaohs, and President Jack Kennedy. All proceeds benefit the continuation of this life cycle and the United Egyptian Imperial-Republic, a secret country based on spiritual rebirth from the Egyptian Other World (Duat).

Alexander, Son of Ammon

release date: Oct 12, 2012
Alexander, Son of Ammon
Alexander, Son of Ammon:Enter a glimpse into the unfinished life of Alexander the Great. Witness his vivid battles, his family problems, and even his sexual fantasies about Amazon warriors. A Macedonian general lifted his visor an inch to taste the wind. He barked out a command and took out a bow and an arrow from his quiver and strung it. Pulling back the bowstring he shot the arrow into the clouds, down it came onto a tree, signaling his legions to charge over the river. The men cheerfully mounted horses and pushed them onwards into the river, splashing the waters with their hooves. Suddenly figures arose from the waters. They carried long curved blades and wore chain link mail over their breasts and loins and mantles. Various blends of colors became their hair as each figure angled their blades and drew blood from the Macedonians in the river. Alexander, weighted under his armor, dismounted his horse and ran towards the leader on foot. She dismounted also. They stood before each other, her with blood and water dripping precariously about her shoulders, him with anger in his voice. Her face grimaced a roar. He struck her across her jaw with his sword hilt. She returned with a blow to his sword, then another. As he was about to slice her ear off she kicked his stomach, forcing him to miss. Another kick landed against his jaw as he drooped forward. He flung his sword at her helmet, knocking it off. Angrily, she jumped onto his body, and they both fell into the waters. Alexander floated above the sandy floor and found her clawing hands searching for him, so he kicked at them with a free leg. She grabbed that leg and forced him towards her. Alexander fell back into the waters. Darkness filled the visible scenery followed by inklings of blood. The Amazon pressed his face into her chest, then tightened her body about his like a snake. He slipped from her grasp, then fell against her abdominal muscles, pressed hard then slipped again until he became entangled in her legs. She pressed her calves against his neck to her thigh then released. He fell away from the Amazon altogether, then surfaced. His mouth burst open for air. Then she stood up above the water and her wet hair on her head rose up as snakes, her eyes turning golden like solar flames. A fireball shot from her mouth and enveloped Alexander, his limbs turning stiff like granite. He felt his hand brush against a metal object floating near the surface so he grasped it with an ounce of remaining strength. It was a shield with a mirror polish. He lifted it up and the Amazon saw her reflection, her smile turning sour then as a shriek of anguish as her body was transformed from flesh to stone. The stone effigy broke into millions of shards as a sword was thrust into it from behind. The owner of the sword disappeared from sight. (c) Copyright 1998, 2012 Michael J. The Flea Market Archaeologist

release date: Aug 29, 2012
The Flea Market Archaeologist
Summary:Archaeology: the lure of treasure-hunters-turned-scientists, the discovery of ancient artifacts and unknown civilizations. Now add Flea Markets to the mixture and you have Cultural Anthropology with antiquities galore. You never know what you will find there. Usually anything of value to history is not on the minds of overly-burdened vendors. Most vendors I had the chance to know want to sell you their prized junk, usually at cheap to modest prices.I collect for educational reasons, not for entertaining value. Each piece is a study-aid, from varied cultures of historical significance. Then came the addiction. Cataloged artifacts were largely over-priced according to the Flea Market vendors'' opinion. Over priced or over- valued is hard to say.I use artifact catalogs mostly to examine what artifacts look like, what time period produced them, their size and shape, etc. This replaces a dig site or artifact books, though my personal "library" contains reference materials from the Near East to Western cultures. I have Stamp Collector books, Coin books (both American and Ancient), books on Marketed toys (the kind used to market films), and history books. For anyone interested in this concept, you will need a few suggestions. First, don''t seem too interested in the item - that is a red flag to the vendor, which may increase the price of the artifact. Second, look around the object: see if there are any other items hidden beneath it or beside it. Once there was a statue I wanted, and it hid a pile of coins I hadn''t noticed before, one of which was a 4 inch Chinese Cash coin. Third, bring a backpack or large duffle for multiple or larger items. I usually carry a backpack, though I prefer to find small objects there. Fourth, invest in plastic sleeves and 3-ring binders purchased at a local Office store; this is to preserve either paper items like postage stamps or currency, and for research materials with photos of the artifacts. Fifth, examine the items for any damage or marks which may indicate age or genuineness (fake artifacts can be identified by structural design or cross section). Researching items before going to a Flea Market is recommended so as to know what characteristics to look for in the vast wasteland of artifacts, if you plan on targeting one particular culture. Bring enough cash [especially one-dollar bills] as most vendors there rarely accept credit cards unless it is sports related or from an actual business like jewelry, College groups, or a marketplace. I have seen small businesses use Flea Markets to attract customers.Copyright 2012 Michael J. Costa, All rights reserved.

Smenkhkara and Meritaton

release date: May 07, 2012
Smenkhkara and Meritaton
Nefertiti bore daughters to her husband. Based on surviving sculptures, in their early years Akhenaton and Nefertiti were happily married. In later years at least one portrait or sculpture shows them holding hands but leaving their expression somewhat depressed. They never had a male heir or son. Nefertiti''s daughters, Meritaton and Ankhesenpaaton, both had female daughters named after them. Even Nefertiti''s sister, Mutnodjmet, never bore a son for her husband Horemhab the future King and then-current General of the Army. Mutnodjmet was found as an element in the "floating barge" with an accompanying dwarf/pygmy among Tutankhamon''s belongings. It is recorded that "Nefertiti fell from grace and moved into the Northern Palace of Akhetaton during the later years of Akhenaton." This does not mean that "she died," for most likely she was divorced as she still lived. Divorce was not uncommon for Ancient Egyptians, but was difficult to express when it happened in the royal palace. The people could not know what happened to her, it would be too devastating. Nefertiti was well respected by the people, as they saw her in the Window of Appearances giving rewards to the citizens, or on temple reliefs in ritual smiting of the enemy. The reason was mostly simple: she did not give her husband a son to inherit his doctrine or continue the dynasty. So what did happen?DNA evidence (2010) has 2 mummies related to each other as "brother and sister," one from KV55 and the Younger Lady mummy. Once thought to be Akhenaton based solely on the condition of its encasement coffin and effaced inscriptions, the KV55 male mummy is someone else. Akhenaton did not have any sisters matching the Younger Lady''s description. My theory is that KV55 mummy is Smenkhkara and the Younger Lady is Akhenaton''s eldest surviving daughter Merit-aton. This means Smenkhkara is Akhenaton''s son by a different source than Nefertiti. Some DNA links hint at a foreign genetic source in the tested mummies, so Smenkhkara''s mother is questionable. Was she another wife of Akhenaton, a secret lover / harem girl, or of a foreign royal bloodline? Smenkhkara adopts the former royal name of Nefertiti to keep the situation current, and to prevent suspicion as to why she is missing. His wife, Meritaton, is the daughter of Nefertiti & Akhenaton, and became the new "Great Royal Wife" of the coregent Nefernefruaton Ankhkheperura. A few years into the new coregency, Smenkhkara drops the reference to Nefertiti and becomes Ankhkheperura Smenkhkara. Gradual name changes give room to smooth transition of power. The people would believe it was the same individuals giving themselves new names or titles; a common practice. Then after Akhenaton died the new Smenkhkara became full sovereign as Djoserkheperura Smenkhkara with Meritaton as Queen. The DNA evidence states that the KV55 Mummy and Younger Lady are the genetic parents of Tutankhamon. Copyright 2012 MJC, All rights reserved.

How to Create Your Own Egyptian Book of the Dead

release date: Apr 25, 2012
How to Create Your Own Egyptian Book of the Dead
The Ancient Egyptians believed in a life after bodily death, as did many other cultures in pre-history. Their sophisticated knowledge of the afterlife compelled them to create houses for the departed souls with enough furnishings to last forever. The basic concept was in book form, and this was copied into pictures and tomb murals that decorated these underground palaces. Since papyrus paper was expensive the tombs were made of stone or mud bricks, and tomb interiors were painted to match the contents of the funerary texts. So if you have such a book, you do not necessarily need a tomb; the dead souls would create their own housing and habitation in the Otherworld by reading about it. If you did not have this book, a tomb would be your home so that your eternal soul would not haunt the living, or demand food and drink offerings from living relatives. With Archaeologists excavating in Egypt for the past 200+ years, numerous tombs have been found there. Some were haunted by the awakened souls detecting the movement of their remains. Some souls returned to Earth in new bodies as people or animals as they did for many centuries. The ancient expression, "To call one''s name is to cause them to live again," means "to live again upon being awoken." Life extends beyond bodily activity. Your soul is shaped by your body, and continues to exist long after the body is no longer here. Some souls such as Tutankhamon are hostile to being disturbed, and so every time his remains are moved or touched, bad reactions occur in the world (this is the so-called "Curse" concept). Now you can create your own Egyptian Book of the Dead and be prepared for Eternal Life with style. This guide book will show you a few ways to prepare for your future existence. You do not need to adopt the Egyptian Mythology or religion, as pre-historical people believed in an afterlife long before the invention of bread. All you need to do is follow these ideas correctly. Modern cultures in Asia already have similar ideas as the ancients had, and can find common concepts.

Orthodox Omnitheism

release date: Sep 12, 2011
Orthodox Omnitheism
In Ancient Egypt, both Monotheism and Polytheism existed in harmony. This lasted until the age of Akhenaton and later Moses. In the 2nd Dynasty there was a disagreement between Horus & Seth followers, like a rivalry between political parties during an American election. This was resolved by adoring both deities. So it shall be with Monotheism and Polytheism of today. That there are millions of interpretations of either system does not matter once the origins or core of each system is evaluated. Orthodox Omnitheism is the worship of all Divinities, whether it is only one, or many. For each Divinity is a Spirit in some form or another, and Spirits dwell in everything and everyone. The Burning Bush (of the Book of Exodus, OT) is actually a Divine Spirit inside a tree that gives off radiation. A Divine Spirit in Egyptian religion that dwelled inside a tree was the Goddess Hathor (Sycamore Tree). Whenever people of Egypt are shown worshiping a Deity, their hands are always up as if warming them at a campfire. So the Burning Bush was actually an Egyptian Deity, an unknown one. New Gods were always discovered by the Egyptians. The Tree-God that Moses discovered was described as a plant that burned but did not consume the bush. "And the Angel of the Lord appeared unto him in a flame of fire out of the midst of a bush; and he looked, and, behold, the bush burned with fire, and the bush was not consumed." (Exodus 3:2).The overall purpose of Religion as a concept is empowerment of Magical Energy. Think of a target deity as the solar cell in a solar station, with thousands of mirrors reflecting sunlight onto it for energy collection. Each mirror is one pious person sending energy to that target god. The target can be a word (Logos), a book (Bible, Quran), a person (Christ), a concept (PAX, Peace), someone with an illness, a building (Temple), or an energy dump site (the Sun). If you empower a word with energy, it becomes a Word of Power; when uttered or written this word forces energy through its definition or action verb. (c) Copyright 2011 Michael J.
